DUSK 'TIL DAWN ENTERTAINMENT (Ltd.) - TERMS AND CONDITIONS

Definitions

"Dusk 'til Dawn Entertainment" means 'Dusk 'til Dawn Entertainment Ltd' trading from 'Studio 12', 12 High Street North, Langley Moor, Durham. DH7 8JG. . "Client" means a person, persons or company who engages a performer or performers using the services of 'Dusk 'til Dawn Entertainment Ltd'. "Artist" means a performer /artists or performers engaged by the Client using the services of 'Dusk 'til Dawn Entertainment'. "Engagement" means a contract between a Client and an Artist or where an agent acting on behalf of an Artist or Entertainer specified. The "agency" means 'Dusk 'til Dawn Entertainment Ltd'.

Legal Status

'Dusk 'til Dawn Entertainment Ltd. acts in the capacity of an agent to the Artist or Entertainer in negotiating Engagements. The Agency operates as an 'Employment Business' in supplying the 'Client' with Artist/s.

Agency Fees

'Dusk 'til Dawn Entertainment' charges one fee per Engagement.

The fee that the agency works for is a pre arranged fee with the artist for each engagement.

Deposits

'Dusk 'til Dawn Entertainment' may ask the Client for a non-refundable deposit, payable in advance. The Agency will retain this deposit as their agency fee, unless an alternative arrangement has been agreed at the time of making the booking, with the client.

Advance Payments

'Dusk 'til Dawn Entertainment' will hold any advance payments/artists fees in their client bank account and will forward the net payment to the Artist either immediately before or after the Engagement has taken place. In some instances, payments to the artist may be made direct from the client, at a pre arranged date and time, as listed in the contract, (in the 'Balance due date' section).

Non-fulfillment of engagement

Should the client cancel the engagement, they will pay a percentage of the gross fee, based on the following scale

  • Weddings- (90-180 days, 50%, 89-30 days, 75%, less than 30 days Full fee)
  • Other – (45-90 days, 25%, 30-44 days , 50%, less than 30 days, 75%)

The Agency is not liable to pay cancellation fees to the artist unless the cancellation fees have been received from the client. The Agency reserves the right not to seek a cancellation fee in extra ordinary circumstances, although the artist may seek the cancellation fee from the client.

Force Majeure

If through illness or circumstances beyond the agency's control and the act is unable to fulfill the engagement as listed in the contract, Dusk 'til Dawn Entertainment Ltd. shall endeavor to supply a deputy of equivalent ability. In the unlikely event of total failure or cancellation of this contract by the Act, liability is limited to a full refund of all monies paid.

Future Engagements and client/ artists representation

After the first Engagement, all subsequent Engagements involving a Client and artist must be negotiated through 'Dusk 'til Dawn Entertainment' for a period of 12 months from the Artists last Engagement with the Client. If the Artist defaults in this obligation, the agency will be entitled, on each occasion of default, to payment by the Artist of a fee equal to the fee paid to the agency for the last Engagement.

Joint Engagement

'Dusk 'til Dawn Entertainment' may negotiate an Engagement using the services of another agency. This will be known as a Joint Engagement and the artist is informed in this instance.

Public Liability

Our artists are advised to carry public Liability Insurance (PLI) and where applicable, to have their equipment PAT certified. The client should stipulate where PL is a necessity for an engagement. Documents can be forwarded with fair and reasonable notice.

These terms and conditions apply to all Engagements organized by 'Dusk 'til Dawn Entertainment'. They remain in force until cancelled or amended in writing by the agency. These terms and conditions shall be governed by the Law of England and Wales and any disputes arising from any Engagement shall be heard in any Court with the relevant jurisdiction
